Thinglink Terms of Use

By using the Thinglink.org web site, a service of Aula Design Oy, you are agreeing to be bound by the following terms and conditions ("Terms of Use").

Basic Terms

Violation of any of these agreements will result in the termination of your Thinglink account. While Thinglink.org prohibits such conduct and content on its site, you understand and agree that Thinglink cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Thinglink.org service at your own risk.

General Conditions

We reserve the right to modify the Thinglink service for any reason, but we promise to inform on our website about any substantial changes in the service.

We reserve the right to alter these Terms of Use at any time.

We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.

The Thinglink service makes it possible to post images hosted on Flickr to outside websites. This use is accepted. However, pages on other websites, which display images hosted on Flickr must provide a link back to Thinglink or Flickr from each photo to its photo page on Thinglink or Flickr.

We claim no intellectual property rights over the material you provide to the Thinglink service. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your Things on Thinglink.org.

You must read, agree with and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy, which include those terms and conditions expressly set out below, before you may have a Thinglink account.

We may amend this Agreement at any time by posting the amended terms on the Site. This Agreement is effective upon acceptance in registration for new registering users, and is otherwise effective on April 1st, 2006 for all users.

Membership Eligibility

Our services are available to people of all ages, but children under thirteen are advised to use this service under the supervision of your parents or guardians. Your Thinglink account and User ID may not be transferred or sold to another party. If you are registering as a business entity, you represent that you have the authority to bind the entity to this Agreement.

Fees and Services

Having a Thinglink account and registering thinglinks for your work is free. In the event we introduce a new service, the fees for that service are effective at the launch of the service.

Release

In the event that you have a dispute with one or more Thinglink users, you release Thinglink (and our employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Information Control

We do not control the information provided by other users that is made available through our system. You may find other users' information to be offensive, harmful, inaccurate, or deceptive. By using this Site, you agree to accept such risks and Thinglink is not responsible for the acts or omissions of users on the Site.

Fraud: Without limiting any other remedies, Thinglink may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.

Your Information

Definition:"Your Information" is defined as any information you provide to us or other users in the registration, listing process, in any public message area (including the the comment area) or through any email feature. You are solely responsible for Your Information, and we act as a passive conduit for your online distribution and publication of Your Information.

Restricted Activities: Your Information (or any items listed) and your activities on the Site shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the display of counterfeit or stolen items; (c) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, antidiscrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain child pornography; (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

Privacy

"Personal information" means information that would allow a party to identify you, such as, for example, your name, web address, or email address.

We collect personal information at three places on our Site: (1) when registering a Thinglink account; (2) when you provide us with your personal information such as by sending an email to us; and (3) when you donate money to us or purchase merchandise via our support page.

We use the personal information you provide to us when you send us emails or sign up to our service in order to respond to your request, for example, to reply to your email or to send you communications about news and events related to Thinglink. If you purchase stickers or other merchandise directly from Thinglink, we will use your personal information for the purpose of sending you the items you purchased.

Your user name that you have provided us at registration will typically be visible to other users when you comment a thing to another user on the Site. Also, when you donate money as part of one of Thinglink fundraising campaigns, your name will be published on our "supporters page" unless you request otherwise.

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent.

When you donate money to us or purchase merchandise via our support page via PayPal, your personal information will be handled by and stored by PayPal (https://www.paypal.com/) in accordance with its Terms of Use and Privacy Policy.

Non-personal browsing and site usage information that we collect

When you use the Thinglink service, our servers (which may be hosted by a third party service provider) may collect information indirectly and automatically (through, for example, the use of your "IP address") about your activities while visiting the Websites, including the web pages you view and the times you view them and information about the browser you are using. We do not link browsing information to the personal information you submit to us; we use this browsing information for internal purposes such as to help understand how the Websites are being used and to improve it, and for systems administration purposes. An IP address is a number that is automatically assigned to your computer when you use the Internet. In some cases your IP address stays the same from browser session to browser session; but if you use a consumer Internet access provider, your IP address probably varies from session to session.

We view protection of users' privacy as a very important community principle. We understand clearly that you and your information is one of our most important assets. We store and process your information on computers located in Finland that are protected by physical as well as technological security devices. If you object to your Information being transferred or used in this way please do not use our services.

No Warranty

We, our officers, directors, employees, and our suppliers provide our website and services "as developing" and without any warranty or condition, express, implied or statutory.

Liability Limit

IN NO EVENT SHALL WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).

Indemnity

You agree to indemnify and hold Thinglink (and our directors, employees or partners) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

Resolution of Disputes

Our goal is to make you happy by providing you free product codes. In the event a dispute arises between you and Thinglink, please email thinglink at ulla@aula.cc, and we will work quickly towards a solution.
